Terms and Conditions

Effective Date: April 27, 2025

These Terms and Conditions (“Agreement”) govern your use of any coaching services, programs, communities, courses, or materials provided by Emily Bettdur (“Coach”, “we”, “us”) through the website www.emilybettdur.com and all affiliated platforms and offerings, including but not limited to:

  • 1:1 Personalized Coaching Packages
  • Group programs and workshops
  • 1:1 or Group Mind Shifting Sessions
  • The Late Life Lesbian Community
  • Free and paid resources, digital downloads, and courses

By purchasing, registering for, or participating in any of the above services (“Services”), you (“Client”, “you”) acknowledge that you have read, understood, and agreed to these terms.

1. Eligibility & Personal Responsibility

Clients must be 18 years of age or older to participate. You agree to take full responsibility for your own physical, mental, and emotional well-being, decisions, actions, and results during and after your use of our services. Coaching is not therapy, medical treatment, or legal advice, and no such relationship is implied.

2. Personalized 1:1 Coaching Packages

a. Package Overview

Coaching packages vary in duration and frequency depending on the Client’s goals and selected plan. All packages include:

  • Private 1:1 coaching sessions (length and number determined by package selected)
  • Access to Coach between sessions via email or text for support as needed within reason (response time: 24–48 business hours)
  • Optional check-ins initiated by Coach to support accountability and progress

b. Timeline & Expiration

Coaching sessions must be used within the designated timeframe outlined at the time of purchase. Clients are encouraged to maintain momentum by scheduling sessions regularly.

Extensions may be offered for vacations, illness, or emergencies at Coach’s discretion.

c. Scheduling & Attendance

Sessions are scheduled based on Coach’s availability. Clients must give at least 8 hours’ notice to reschedule. Less than 8 hours notice may result in forfeited session without refund. Missed sessions without notice may be forfeited without refund. This will be determined on a case by case basis and at the Coach's discretion.

d. Temporary Pause by Coach

If Coach is temporarily unavailable due to illness, emergency, or vacation, she will:

  • Notify clients promptly
  • Resume services ASAP
  • Offer makeup sessions as appropriate

If services cannot be resumed, a prorated refund may be issued (see Refund Policy below).

3. Access to Coach and Communication

Client may contact Coach via email or text between sessions for additional light support. Coach guarantees a response within 24-48 hours of normal working hours or unless otherwise communicated. Excessive or inappropriate communication may result in additional boundaries being enforced or require an upgrade to a new coaching package.

4. Payment and Refund Policy

All payments are final and non-refundable. This includes but is not limited to coaching packages, group programs, digital products, and community memberships. Exceptions will only be made if the Coach is permanently unable to fulfill her obligations.

5. Intellectual Property

All content provided by the Coach—including but not limited to videos, worksheets, frameworks (such as REAL: Release, Embrace, Act, Live), and written materials—is the intellectual property of Emily Bettdur and may not be copied, shared, or redistributed without written permission.

6. Confidentiality

The Coach agrees to maintain confidentiality of all private client information shared within sessions or via written communication, except where required by law or to prevent harm.

You may not share details of other members from group programs or community spaces. Respect for privacy and confidentiality is a core community value. Violation of this may result in immediate removal of any group or community spaces without refund.

7. Results Disclaimer

All coaching packages and programs are designed to support transformation, but individual results may vary depending on personal effort, mindset, and participation. No outcomes are guaranteed.

8. Technology and Platform Use

You agree to access our content and services through the platforms designated (e.g., private client portals, Zoom, email, etc.). You are responsible for ensuring you have access to the necessary technology and internet connection. We are not liable for technical issues on your end that result in missed services.

9. Code of Conduct

Clients agree to:

  • Communicate respectfully and responsibly
  • Be open to feedback and growth
  • Show up on time and prepared for sessions
  • Honor all boundaries and agreements
  • Respect privacy and confidentiality of other individuals

Any violation of these terms may result in termination of the client relationship without refund.

10. Limitation of Liability

To the fullest extent permitted by law, Coach shall not be held liable for any damages or results that may occur in connection with your use of this website, services, or coaching content.

11. Modifications to Terms

We reserve the right to update these Terms and Conditions at any time. Any changes will be posted on www.emilybettdur.com, and your continued use of our services signifies your acceptance of updated terms.

12. Governing Law

This Agreement shall be governed by the laws of the state in which Coach resides. Any disputes arising out of this Agreement will be handled in accordance with those laws.

This disclaimer applies to all content, services, products, programs, and resources provided by Emily Bettdur and her affiliated businesses, including but not limited to The Late Life Lesbian LLC, Mind Shifting for Success, The Late Life Lesbian Community, and any related coaching programs, courses, events, email communications, websites (including www.emilybettdur.com), and other offerings ("Services"). By accessing or engaging with any of these Services, you acknowledge and agree to the following terms:

1. Not Medical, Psychological, or Legal Advice

All Services are intended for informational, educational, and personal development purposes only. Coaching and guidance offered are not a substitute for professional medical advice, mental health treatment, or legal counsel.

2. No Guarantees of Results

While our coaching and offerings are designed to support personal growth and transformation, individual outcomes vary. No guarantees are made regarding specific results.

3. Voluntary Participation

Engagement with Services is voluntary. You may discontinue at any time. All actions taken based on coaching are your own responsibility.

4. Confidentiality and Privacy

Information shared in coaching or community spaces will be kept confidential per our Privacy Policy, unless required by law or if harm is suspected.

5. Personal Responsibility

You agree that you are fully responsible for your well-being and any decisions or consequences that arise from your participation in our Services.

6. Not Suitable for Minors

Services are for individuals 18 and older unless parental consent is provided and verified.

7. Limitation of Liability

Emily Bettdur and all associated entities are not liable for damages or consequences resulting from participation in Services, including emotional, financial, or professional outcomes.

8. No Endorsement

Mentions of third-party services or organizations are not endorsements unless explicitly stated.
